In his youth, Kimo worked on a California ranch during the school year and fished with his grandfather in Ha- wai‘i during the summer.
This week, we are excited to welcome Kimo into our kitchen, where he shares his recipe for Ono Ceviche.
      ONO CEVICHE
• 2 pounds ono filets, cut into 1-inch pieces
• 1 cup lemon juice
• 2 tablespoons kosher salt
• dash of white pepper
• 1/2 cup round white onion,
chopped
• 2 cloves garlic, minced
• 1 large tomato, chopped
• 1 medium serrano or
jalapeño pepper
• 1/2 cup cilantro,
minced
• 1/4 cup olive oil
Put lemon juice, onion, gar- lic, tomato into a non-metal bowl. Add peppers, cilantro, salt and oil. Toss in fish and mix well. Refrigerate mini- mum 6 hours. Turn once when ready to serve. Add more lemon juice and salt if needed.
  He moved to the Aloha State in 1979 after gradu- ating from California Poly- technic State University, San Luis Obispo with a degree in agriculture. For 20 years, Kimo managed agricultural research and production for Pioneer Mill Co. on Maui.

I recently read about an agent who specializes in sales oflakefrontproperty. Hementionsconsiderationof waterdepth,shallowspots,idlezones,channelsand big water views as things buyers and sellers in his marketshouldconsider. Ihavetobehonest,even though I grew up on a huge river, I’d never heard of someoftheseissues. Ifoundmyselfthinkinghow luckyhisclientsarethattheiragentreallyknowsthe area. Ofcourse,onHawaiiIsland,wehavequirky issues like catchment, SSPP participation, lava
tubes,lavazones,tsunamievacuation/ inundation areas, and special management areastonameafew. Theseareactually
fairly straightforward, easy to understandissues. Unfortunately,the issueof“CustomaryandTraditional
HawaiianRights”isn’tquitesosimpleto
explain. Infact,withoutanastuteagent, it’s an issue that sometimes slips in as an exception to thetitleinsurancecoverage. Nativerightshavetwo sources. One emanates from the original grant and is thereforecontainedintheoriginalchainoftitle. This typereservationisalmostimpossibletoremove. The
other type is a reservation established by law and by a HawaiiSupremeCourtDecision**commonlyreferred toasPASH. Inanutshell,thesereservationsmeanthat individuals of Hawaiian ancestry (and possibly others) whohavetraditionallyenteredandusedthepropertyfor customary and traditional practices may have the right tocontinuedoingso. Traditionalpracticesaregenerally forsubsistence,gathering,access(forinstance,to gravesites)andforculturaland/orreligiouspurposes. The list and interpretation is fairly broad, however, the righttoenterthepropertyofothersisrarelyexercised because establishing historical use really isn’t so simple. PropertiessubjecttoPASH,forinstance,have a limitation to “undeveloped” and “underdeveloped” parcels. InEastHawaii,wemostcommonlyseethese exceptionsNorthofHiloandmostcommonlyonlarger piecesofland. Thisisnotuniversallytrue. Ihaveseen theexceptionevenonaresidentialproperty. Whilethe reservation may never become a practical problem, it’softenanissuewithlenders. Sometitlecompanies will “insure over” the exception. This basically means thattheywillissuethetitleinsurancepolicybutif theywillnotcoverclaimsrelatedtotheomittedissue.
This is commonly done when a structure encroaches intoasetback,forinstance. PASHreservationsare sometimesremovedbyprovidingprooftothetitle insurer that there are no archeological, graves or historicalsitesontheproperty. Otherconsiderations would be the existence of physical features such asstreams,trails,gulchesorfishpondsincludedon mapsorhistoricaldocuments. Theproximitytoceded lands,theocean,heiau/otherarcheologicalsitesand
a determination of development status of the property areotherconsiderations. Titlecompaniesusevarious methods for determining if an exception can be removed. Forthoseconsideringapurchase(especially) along the Hamakua Coast, it’s a good idea to ask the seller’sagentforapreliminarytitlereportfromthe get-go.
